Australia introduced important changes to its Student visa (subclass 500) and Student Guardian visa (subclass 590) rules from 2 October 2026.
The changes affect where certain applicants can lodge a visa application, whether family members can be included, and whether dependants can join a Student visa holder later.
For students planning to study in Australia in 2026 or 2027, understanding these changes early can help avoid invalid applications, unexpected travel requirements and complications involving family members.
What Changed from 2 October 2026?
Under the new rules, most Student visa applications must now be lodged from outside Australia.
Most affected temporary visa holders need to be outside Australia when lodging a Student visa or Student Guardian visa application. Where an applicant is required to lodge offshore, they must also be outside Australia when the visa is granted.
These changes are particularly relevant to:
- Temporary visa holders planning to apply for a Student visa while in Australia
- Existing Student visa holders applying for another Student visa
- Applicants who want to include a partner or dependent children
- Students considering whether family members can join them later
The changes do not cancel or alter an existing valid Student visa.
Can Student Visa Applicants Include Family Members?
From 2 October 2026, most Student visa applicants can no longer include a partner or dependent children in their Student visa application unless an exemption applies.
This also applies to applicants lodging a further Student visa application.
Limited exemptions may apply to:
- PhD students
- Students sponsored by the Department of Foreign Affairs and Trade or Department of Defence
- Foreign-government scholarship recipients
- Eligible students from certain Pacific countries and ASEAN member countries
Applicants should check the exact eligibility requirements rather than assuming that being in one of these categories automatically qualifies them for an exemption.
What if Family Members Are Already on Your Student Visa?
There are some circumstances where family members already included on a current Student visa may also be included in a further Student visa application.
This may apply in certain situations involving course completion, provider default or eligible course progression.
Because the conditions can vary, students should check the requirements that apply to their individual circumstances before lodging another application.
Family Members Must Be in the Same Location
Where family members are eligible to be included, the primary applicant and all family members included in the application must be in the same location when the application is lodged.
This makes it especially important to plan family arrangements before submitting a Student visa application.
Can Family Members Join the Student Later?
This is one of the most important changes.
Once a Student visa has been granted, family members cannot later be added as subsequent entrants to that Student visa.
There are no exemptions to this rule.
Students planning to study in Australia with their spouse or dependent children should therefore consider their family arrangements before lodging the initial Student visa application.
Can You Apply for Another Student Visa While in Australia?
Most current Student visa holders can no longer automatically lodge another Student visa application while remaining in Australia.
Unless they meet one of the limited exemption criteria, they may need to:
- Leave Australia before lodging the new Student visa application
- Lodge the application from outside Australia
- Be outside Australia when the new Student visa is granted
Exemptions for Onshore Student Visa Applications
Some current Student visa holders may still be able to lodge another Student visa application while remaining in Australia.
Possible exemption circumstances include:
- Needing up to an additional 12 months to complete existing studies
- Being sponsored by DFAT or the Department of Defence
- Applying to undertake a PhD
- Applying for primary or secondary school studies
- Completing a main course and progressing to a higher AQF-level course
- Certain eligible course-progression circumstances
- Being unable to continue a course because the education provider has defaulted
Some exemptions have additional conditions. Students should therefore check their individual circumstances carefully rather than assuming that a course change automatically qualifies them.
What if You Hold a Student Visa as a Dependant?
If a person currently holds a Student visa as a dependant and wants to apply for a Student visa as the primary applicant, they may be required to apply from outside Australia.
Depending on the applicable rules, they may also need to be outside Australia when the new Student visa is granted.
Students in this situation should confirm the current requirements before lodging a new application.
What Happens to Applications Lodged Before 2 October 2026?
Student visa applications lodged before 2 October 2026 will continue to be assessed under the rules that were in place when they were lodged.
This also applies to applications lodged before that date that already included eligible family members.
So, if an application was validly lodged before the new rules took effect, it will generally continue under the previous rules.
What Happens if You Apply from the Wrong Location?
Applicants should pay particular attention to where they are permitted to lodge their application.
If a Student visa application is lodged inside Australia when the applicant is required to apply offshore, the application can be invalid.
Similarly, if a family member who is not eligible to be included is added to the application, that family member’s application may also be invalid.
This can create serious complications, particularly where an applicant’s existing visa is close to expiry.
Can You Return to Australia While an Offshore Application Is Being Processed?
An applicant who is required to lodge offshore may be able to return to Australia on another valid visa while their Student visa application is being processed.
However, where the application is subject to an offshore grant requirement, the applicant must again be outside Australia when the Student visa is granted.
An offshore Student visa application also does not provide a Bridging visa.
What Should International Students Check Before Applying?
Before enrolling in another course, making major financial commitments, booking travel or lodging another Student visa application, students should check:
- Whether they can apply while in Australia
- Whether they are required to lodge from outside Australia
- Whether an onshore exemption applies
- Whether a partner or dependent children can be included
- Whether all applicants need to be in the same location
- Whether the proposed course progression meets the relevant requirements
- Whether the applicant must be outside Australia when the visa is granted
Early planning is now more important than ever.
Does This Mean Australia Is Closed to International Students?
No.
Australia continues to accept international students who meet the relevant Student visa and eligibility requirements.
The main change is that applicants now need to pay closer attention to:
- Where they lodge their application
- Whether they qualify for an exemption
- Whether family members can be included
- Whether they need to be outside Australia at the time of visa grant
